On Wednesday, Assemblyman Marc Levine proposed giving Californians yet another chance to weigh in: the San Rafael Democrat is introducing a constitutional amendment that would abolish capital punishment if approved by voters in 2020.

Newsom said Wednesday that, before he took office, discussing the death penalty was an "intellectual" exercise. Richard Allen Davis was later sentenced to death for kidnapping, raping and murdering her.
While campaigning for governor a year ago, Newsom said he was fervently opposed to the death penalty but didn't "want to get ahead of the will of the voters" and wanted to "give the voters a chance to reconsider".
Senator Kamala Harris, who is among a crowded field of candidates seeking the Democratic presidential nomination, said she welcomed Newsom's move to end the "deeply flawed system of capital punishment in California".
"I've never believed in the death penalty from a moral perspective", he said.
Weight should be given to Newsom's point that a number of death row occupants are eventually released because they were wrongly convicted. Voters also defeated a 2012 measure to end the death penalty. A governor needs approval from the state Supreme Court to pardon or commute the sentence of anyone twice convicted of a felony, and the justices past year blocked several clemency requests by former Gov. Jerry Brown during his last full month in office. As with so many other issues - climate change, abortion, taxes - there is a wide gulf on how states approach capital punishment. Republican Illinois Gov. George Ryan was the first to do so in 2000, though Illinois has since abolished the death penalty. IL ultimately outlawed executions, as did Washington.
"Our death penalty system has been - by any measure - a failure", Newsom said in a written statement. Twenty-five of the death row prisoners have exhausted all appeals. The California Constitution gives the governor power to grant reprieves to inmates, providing he reports his reasoning to the Legislature. During that same time, 79 death row inmates have died of natural causes and 26 have died by suicide, according to the California Department of Corrections and Rehabilitation.
